    Commentary on the Decree of the Ministry of Labor and Social Protection of the Republic of Belarus dated October 22, 2015 No. 64 "On the establishment of the estimated norm of working hours for 2016".

    In accordance with Article 124 of the Labor Code of the Republic of Belarus (hereinafter referred to as the Labor Code), for each calendar year, the Government of the Republic of Belarus or its authorized body establishes the estimated norm of working hours for each calendar year.

    Based on the Regulations on the Ministry of Labor and Social Protection of the Republic of Belarus, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated October 31, 2001 No. 1589 “Issues of the Ministry of Labor and Social Protection of the Republic of Belarus”, the estimated norm of working time for each calendar year is established by the Ministry of Labor and Social protection of the Republic of Belarus.

    For 2016, the estimated norm of working time was established by the Decree of the Ministry of Labor and Social Protection of the Republic of Belarus dated October 22, 2015 No. 64 “On the establishment of the estimated norm of working hours for 2016” (hereinafter referred to as Resolution No. 64), according to which, with a full norm of working hours (40 hours per week) the estimated working time for 2016 will be:
    for a five-day working week with days off on Saturday and Sunday - 2038 hours;
    for a six-day working week with a day off on Sunday - 2044 hours.

    The calculation of the estimated norm of working hours for 2016 was carried out in accordance with the Clarification on the procedure for determining the estimated norm of working hours and the hourly wage rate in the Republic of Belarus, approved by the Decree of the Ministry of Labor of the Republic of Belarus dated October 18, 1999 No. 133 (hereinafter referred to as Resolution No. 133).

    The estimated norm of working time is set on the basis of the full norm of working hours of 40 hours per week (Article 112 of the Labor Code) for a five-day working week with days off on Saturday and Sunday and for a six-day working week with a day off on Sunday.

    The estimated working time norm established by Decree No. 64 is used by the employer to determine the number of employees, the length of working time during which the employee is required to be at the workplace, scheduling work (shifts), and also in order to monitor compliance with the norms of working hours established by the Labor Code .

    It should be borne in mind that not in all cases the estimated norm of working hours can be applied to a particular employee. If the employee did not work during the calendar year or in certain periods of it for good reasons (due to temporary disability, labor and other holidays, in other cases provided for by law), then the employer independently determines the specified working time norm for these employees.

    Also, if the organization has a different mode of operation (with a five-day working week, in which employees are given days off not on Saturday and Sunday, or with a six-day working week with a day off not on Sunday, but on another day of the calendar week, or with shift work , as well as under other regimes), then the estimated norm of working time established by the Ministry of Labor and Social Protection may not be applied.

    Under the above and other modes of working hours, the employer independently ensures the determination of the estimated norm of working hours in compliance with the norms of Articles 112 - 117 of the Labor Code, Resolution No. 133, and sets its value for the corresponding calendar year (month, quarter, year) by its local regulatory legal act , which will be for the employees of the organization the full norm of working hours.

    In the event of an employee's absence from work (temporary disability, social leave, performance of state duties, etc.) (hereinafter referred to as the time of absence), the time of absence that falls on hours (days) according to the work (shift) schedule is excluded from the actual working time.

    In 2016 there are 366 calendar days. Of this number of days, with a five-day working week there will be 255 working days, and with a six-day working week - 308 working days (12 calendar months are taken into account). The average monthly number of working days in 2016 will be 21.3 days with a five-day working week, and 25.7 days with a six-day working week.

    When determining the number of working days, the number of calendar days excludes days off according to the calendar of a five-day (Saturday and Sunday) or six-day (Sunday) working week, as well as public holidays and public holidays, which, in accordance with paragraph 3 of Decree of the President of the Republic of Belarus dated 26.03.1998 No. 157 "On public holidays, holidays and memorable dates in the Republic of Belarus" (hereinafter - Decree No. 157) are declared non-working days.

    Of the nine non-working holidays, eight are celebrated on the days established by Decree No. 157, and the ninth holiday Radunitsa is celebrated 9 days after the Easter holiday, according to the calendar of the Orthodox denomination in the corresponding year.

    In 2016, non-working holidays will be:

    • January 1 - New Year;
    • January 7 - Christmas (Orthodox Christmas);
    • March 8 - Women's Day;
    • May 1 - Labor Day;
    • May 9 - Victory Day;
    • May 10 - Radunitsa (according to the calendar of the Orthodox denomination);
    • July 3 - Independence Day of the Republic of Belarus (Republic Day);
    • November 7 - Day of the October Revolution;
    • December 25 - Christmas (Catholic Christmas).
    In 2016, holidays fall on Sunday: May 1 - Labor Day, July 3 - Independence Day of the Republic of Belarus, December 25 - Christmas (Catholic Christmas).

    It should be noted that the religious holiday "Easter", according to Decree No. 157, both according to the calendar of the Orthodox denomination and the calendar of the Catholic denomination, is not declared a non-working day, and the day of celebration always falls on Sunday. Consequently, for employees whose working hours are determined by the work (shift) schedule and the work (shift) time falls on Sunday (the religious holiday Easter), wages on the specified day are made in the usual manner, i.e. like a job on a weekday. When employing employees for whom, according to the established working hours, the day of the religious holiday "Easter" is a day off, compensation for work on this day is made in accordance with the norms of Article 69 of the Labor Code.

    In accordance with Article 69 of the Labor Code, for each hour of work on public holidays, holidays and weekends in excess of the wages accrued for the specified time, an additional payment is made: for workers with piecework wages - not less than piecework rates, for workers with time wages - not less than hourly tariff rates (salaries).

    If work on public holidays and holidays was performed in excess of the monthly norm of working time, the employee, at his request, in addition to the additional payment, may be provided with another unpaid day of rest.

    Please note that a prerequisite for engaging an employee to work on a day off is the presence of an order (instruction) of the employer, which specifies all the conditions for involving him to work on a day off.

    The procedure for engaging in work on weekends and its execution is determined by the norms of articles 142, 143 and 145 of the Labor Code.

    In accordance with the norms of Article 116 of the Labor Code, the duration of work on a working day immediately preceding a public holiday or holiday (hereinafter referred to as pre-holiday days) is reduced by one hour.

    With a six-day working week, pre-holiday days are: January 6, March 7, April 30, July 2, December 24 and December 31.

    This rule applies to all employees, regardless of the length of their working hours.

    This rule does not contain an exception for any categories of employees, including those working part-time, for employees who have reduced working hours or part-time work. Thus, this rule applies to all employees of the organization.

    However, taking into account certain features of part-time work, the duration of work on the eve of the holiday for the specified category of workers should be specified in the local regulatory legal acts of the employer.

    Professional holidays (for example, Lawyer's Day, Teacher's Day, Day of Banking and Financial Workers, Day of Physical Culture and Sports Workers, etc.) are not non-working holidays, and the rule on reducing working hours by an hour on the pre-holiday day does not apply to them .

    In addition, the working day (shift) is not reduced if a non-working holiday is preceded by a day off (according to the calendar or work schedule (shift)).

    If, under the conditions of production, it is impossible to reduce the duration of work, then processing is compensated by agreement of the parties by providing an additional day of rest, paid in a single amount, as these hours accumulate, or by increasing their payment in the amount established for overtime work in accordance with Article 69 of the Labor Code.

    Labor legislation does not establish a period during which an employee is provided with an additional day of rest as compensation for processing on holidays, so the employer needs to establish the conditions for providing an additional day of rest during the accounting period.

    When drawing up work (shift) schedules, it should be taken into account that, in accordance with Article 147 of the Labor Code, work is not performed on public holidays and public holidays established and declared by the President of the Republic of Belarus as non-working.

    On public holidays and holidays, work is allowed, the suspension of which is impossible due to production and technological conditions (continuously operating organizations), work caused by the need for continuous service to the population, organizations, as well as urgent repair and loading and unloading work. At the same time, such work is planned in advance in the work (shift) schedule at the expense of the monthly norm of working time.

    According to the norms of Article 61 of the Labor Code, remuneration of employees of organizations is made on the basis of hourly and (or) monthly tariff rates (salaries) determined in a collective agreement, agreement or employer, and in budgetary organizations and other organizations receiving subsidies, whose employees are equal in terms of wages to employees of budgetary organizations - by the Government of the Republic of Belarus or an authorized body.

    This means that the employer independently establishes the size and procedure for calculating hourly tariff rates, which must be determined in a collective agreement, agreement, and in their absence, another local regulatory legal act of the organization (for example, an order).

    Considering that the procedure for determining the hourly wage rate for the remuneration of employees of commercial organizations is within the competence of the employer, for its calculation the employer can apply both the average monthly norm of working time, calculated in the manner determined by Resolution No. 133, and independently, in the manner prescribed in a local regulatory legal act, taking into account the estimated norm of working hours established annually based on the mode of operation of the organization, which, as a rule, does not change during the calendar year (accounting period), including establishing the average monthly norm of working hours as a constant value that can be determined on the basis of the estimated norm of working time for a number of calendar years (for example, for 5 or 10 years).

    In 2016, with a norm of working hours of 40 hours per week, its average monthly calculation norm for a five-day working week is 169.8 hours (2038 / 12), for a six-day working week - 170.3 hours (2044 / 12), over the past five years for a five-day and six-day working week, the estimated rate will be 168.6 hours ((2037 + 2023 + 2008 + 2015 + 2032) / 5 / 12), for the last ten years it will be 168.8 hours ((2020 + 2016 + 2024 + 2032 + 2050 + 2037 + 2023 + 2008 + 2015 + 2032) / 10 / 12).

    For reference: The Ministry of Labor and Social Protection of the Republic of Belarus has established, for a 40-hour five-day working week with days off Saturday and Sunday, the estimated working time: for 2015 - 2032 hours, for 2014 - 2015 hours, for 2013 - 2008 hours, for 2012 - 2023 hours, for 2011 - 2037 hours, for 2010 - 2050 hours, for 2009 - 2032 hours, for 2008 - 2024 hours, for 2007 - 2016 hours, for 2006 - 2020 hours.

    It is also necessary to take into account that if hourly tariff rates are calculated on the basis of the average monthly norm of working hours, determined taking into account the estimated norm of working hours established for the corresponding calendar year, then in this case the hourly tariff rates and piece rates must be recalculated annually.

    This is due to the fact that the value of the estimated norm of working hours of the calendar year changes annually, therefore, the value of the average monthly norm of working hours of the corresponding calendar year also changes.

    When planning working hours in 2016, it must be taken into account that in accordance with the Decree of the Council of Ministers of the Republic of Belarus dated November 23, 2015 No. 976 “On the transfer of working days in 2016” (hereinafter referred to as the Resolution), working days in 2016 are transferred:

    • from Friday 8 January to Saturday 16 January;
    • from Monday March 7th to Saturday March 5th.
    At the same time, the norm of working hours for the 1st quarter of 2016 does not change.

    Planning and recording of working time are carried out by employers in accordance with the Rules for planning and recording the working time of employees in connection with the transfer of certain working days by the Council of Ministers of the Republic of Belarus, approved by the Decree of the Ministry of Labor of the Republic of Belarus dated June 25, 2001 No. 75 (hereinafter referred to as the Rules). The rules apply exclusively to the transfer of individual working days in the corresponding calendar year, announced by the resolutions of the Council of Ministers of the Republic of Belarus.

    In accordance with Article 136 of the Labor Code, the employer is granted the right to transfer only the day off provided for by the internal labor regulations or the work (shift) schedule to another calendar week and these transfers are not related to the transfers of working days carried out by the Government of the Republic of Belarus.

    At the same time, it should be borne in mind that the transfers apply only to employees of organizations that have a five-day working week with days off on Saturday and Sunday, and also for which the transferred day is a working day, and do not apply to employees of organizations that have a summarized accounting of the working day. time, as well as those working on a six-day work week.

    In the event that for various reasons (vacation, illness, performance of state or public duties, other cases provided for by law) the postponed working day for a particular employee was not a working day, then such a transfer does not apply to him.

    So, for example, if the working day from Monday March 7 is moved to Saturday March 5, 2016, then for employees who will be on labor or social leave on March 7, March 5 will be a non-working day.

    If, due to production needs, such an employee, with his consent, will be involved in work on March 5, then this work should be compensated as work on a day off.

    In addition, in the case of employment of employees after January 8 and before January 16, 2016, the transfer of the working day of January 8 to Saturday January 16 does not apply to them.

    It should be noted that when attracting employees to work on weekends and holidays, as well as when postponing working days in the manner determined by the resolutions of the Council of Ministers of the Republic of Belarus, it is advisable to provide the employer with other days of rest within the current month in order to comply with the monthly estimated norm of working time.

    If the transfer is not carried out within one month, then the order (instruction) of the employer simultaneously determines the estimated norm of working hours for each month affected by the transfer.

    According to Art. 112 of the Labor Code of the Russian Federation, non-working holidays in Russia are the following dates:

    Transfer of holidays in the production calendar

    In 2016, due to the coincidence of holidays with days off, the days off are transferred in the production calendar of the following days:

    January 8 → January 16
    March 7 → March 5
    If a day off and a non-working holiday coincide, the day off is transferred to the working day following the holiday, with the exception of days off coinciding with non-working holidays from January 1 to January 8.
